TERMS & CONDITIONS
Effective Date: January 1st, 2026
1. Liability Limits
Lake House Media’s liability for any claim, loss, or injury arising from services rendered is limited to the total amount of fees paid by the client. Under no circumstances shall Lake House Media be liable for special, incidental, indirect, or consequential damages, including but not limited to loss of profits, loss of use, or third-party claims.
2. Image Ownership & Copyright
All photographs and videos created by Lake House Media remain the sole and exclusive property and copyright of the photographer. Clients receive high-resolution JPEG images and/or MP4 video files without watermarks. RAW files are not provided.
Clients are granted a license to use the images, but do not own the images. Ownership, copyright, and all intellectual property rights remain with Lake House Media at all times.
3. Licensing & Usage Rights
All media is licensed, not sold. Licensing is granted per property and is non-exclusive and non-transferable. Usage rights vary based on property type:
a. Real Estate Sales Listings
Includes a non-exclusive, non-transferable license to use the media solely for marketing the property during its active listing period, up to a maximum of 12 months. The license expires when the property is sold, rented, withdrawn from the market, or the listing agreement ends.
b. Short-Term & Vacation Rentals
Includes a non-exclusive, non-transferable license to use the media for marketing purposes across rental platforms (Airbnb, VRBO, personal websites, etc.) for up to 6 years, unless otherwise stated in writing.
Any reuse, transfer, resale, or continued use beyond the licensed term constitutes copyright infringement and may result in additional licensing fees, takedown requests, or legal action.
4. Image Alterations
Images may not be materially altered, filtered, manipulated, AI-modified, or edited by third parties. Basic cropping or resizing for MLS or web use is permitted. Any additional editing requests beyond standard delivery will incur additional charges.
5. Property Readiness Requirement
Properties must be fully ready upon the photographer’s arrival. This includes completion of cleaning, staging, moving, maintenance, and preparation.
Lake House Media does not wait for cleaners, movers, contractors, or staging adjustments. If the property is not ready at the scheduled time, the session may proceed as-is, be rescheduled at the photographer’s discretion, or be considered completed with no refund. Additional fees may apply.
6. Image Count & Square Footage Guidelines
Lake House Media pricing is based on reported square footage. Image counts are guidelines only and may be limited, but are not guaranteed, as image quantity depends on layout, features, condition, and shoot circumstances.
Homes up to 3,000 sq ft: 25–35 images
Homes 3,001–5,000 sq ft: 40–50 images
Homes 5,001–7,000 sq ft: 55–65 images
Homes 7,001–9,000 sq ft: 70–80 images
Incorrect square footage provided at booking may result in additional charges.
7. Digital Delivery & Hosting
Images are professionally processed and delivered within 24–48 hours, excluding weekends and holidays. Virtual tour hosting is included for 3 months, unless otherwise stated. Hosting extensions are available for an additional fee and will be communicated prior to expiration.
8. Payment Terms
Payment is due upon delivery notification. Final media will remain locked and will not be released until payment is received in full. Online payment links are provided for convenience.
9. Cancellations & Rescheduling
Cancellations within 48 hours of the scheduled session must be rescheduled within 7 days, or liquidated damages equal to 50% of the session fee may apply. Reschedules are permitted within the same calendar year.
Weather-related reschedules are permitted when conditions are unsafe or unsuitable for shooting, at the photographer’s discretion.
10. Re-Shoots
Re-shoots are not guaranteed and are offered solely at the photographer’s discretion. Re-shoots will not be provided due to client oversight, property condition, weather changes, access issues, or subjective preferences. Additional fees may apply.
11. Location & Access Costs
Clients are responsible for any costs associated with the shoot location, including parking, access fees, or permits. Lake House Media does not arrange or prepay these costs.
12. Travel Fees
A travel fee of $1.50 per mile applies to any shoot exceeding 50 miles round trip, up to a maximum of 200 miles round trip. Weekend sessions incur an additional $100 fee.
13. Model Release & Promotional Use
The photographer may use images for portfolio, marketing, advertising, social media, and website purposes. Clients agree to indemnify and hold harmless Lake House Media from any claims related to image usage by themselves or third parties.
14. Safe Working Environment
Lake House Media reserves the right to stop or refuse services due to unsafe conditions, including severe weather, unsafe locations, hostile individuals, animals, or communicable disease exposure. Refunds are not provided in these cases. Clients are responsible for providing a safe working environment.
15. Digital Storage & Backup
Clients are responsible for downloading and archiving their images. Online galleries remain available for one year. Lake House Media does not guarantee permanent storage and is not liable for data loss due to technological changes or failure.
16. Indemnification
The client agrees to indemnify and hold harmless Lake House Media from any claims, damages, injuries, or losses arising during or after the photography session.
17. Force Majeure
Lake House Media shall not be liable for failure to perform services due to events beyond reasonable control, including natural disasters, government actions, or emergencies. Refunds are not issued, though rescheduling may be offered when feasible.
18. Breach of Agreement
Any breach of this agreement, including unauthorized use of images, may result in termination of services, revocation of licenses, additional fees, or legal action. Recoverable damages are subject to liability limits.
19. Governing Law & Venue
This agreement shall be governed by the laws of the State of Missouri. Any disputes shall be resolved in Morgan County, Missouri. Clients are responsible for all legal and collection fees incurred in enforcement.
20. Acceptance of Terms
By placing an order, booking services, or receiving media from Lake House Media, the client acknowledges that they have read, understood, and agreed to these Terms & Conditions. This agreement is legally binding.
21. Applicability to All Orders
These Terms & Conditions apply to all current and future orders, photography sessions, and services provided by Lake House Media, whether booked before or after the effective date of this agreement. Continued use of services, receipt of media, or placement of additional orders constitutes acceptance of the most current version of these Terms & Conditions.
